In a basement opposite the Palace of Justice, the General Security tortures with impunity

On Friday, Ammar Al Zubeidi, 35, an Iraqi refugee detained arbitrarily for a year and a half for illegal entry into Lebanon, who was about to be resettled in a third country, was allegedly expelled to Iraq. One case among many others...

While he was initially sentenced to one month and a half in prison, Ammar Al Zubeidi was imprisoned in Jezzine prison then in Roumieh prison without any legal justification nor news from his family, before undergoing hell at the hands of the General Security. Imprisoned three months in the underground cages that serve as a retention center to the General Security, Ammar Al Zubeidi had called CLDH several times, desperate and exhausted, before finally being prevented from contacting our organization.

CLDH had managed to briefly meet him on April 12th in the presence of officers of the General Security. He was presenting signs of severe physical and mental deterioration, his complexion was yellow and he was confused. The UNHCR and the lawyers having no access to the retention center, he had not been informed in time that the interview for resettlement was scheduled on May 19th.

This practice of the General Security, which consists in keeping the refugees in its retention center underground, and making them suffer all sorts of hardships and humiliations without real external control in order to make them sign their "voluntary repatriation" to their countries of origin despite their refugee status granted by the UNHCR, strictly corresponds to the definition of torture under the terms of the Convention against Torture, ratified by Lebanon in 2000.

Moreover, this practice constitutes a violation of Article 3 of CAT, which prohibits the deportation of anyone to a country where he/she is at risk of torture.

CLDH demands that all refugees illegally detained in Lebanese prisons be released without any delay, that an agreement be reached between the UNHCR and the Lebanese authorities on the status of refugees, that the practice of torture by the General Security stop immediately, that a mechanism for effective control of this facility be introduced, and that a new retention center that respects human rights be open.

Regarding Ammar Al Zubeidi, CLDH holds the Lebanese authorities directly responsible for the fate that he might suffer in Iraq and urges the Ministry of Interior to take with the Iraqi authorities all necessary steps to ensure his legal return to Lebanon and allow him to appear on May 19th to his resettlement interview.

في طابق سفلي مواجه لقصر العدل: الأمن العام يعذّب ويفلت من العقاب

كان اللاجئ العراقي "عمار الزبيدي" سيُساق إلى "العراق" نهار الجمعة، علمًا أنّ هذا اللاجئ البالغ من العمر 35 سنة، والمحتجز تعسفيًا منذ أكثر من سنة ونصف لدخوله لبنان بصورة غير شرعية، كان على وشك إعادة توطينه في بلد ثالث. وتشكل هذه الحالة نقطة في بحر حالات أخرى؛

ففي حين حُكم على "عمار الزبيدي" في البداية بالسجن لمدة شهر ونصف، ما لبث أن سُجن في سجن "جزين"، ثم أُرسل إلى سجن "رومية" بدون أي مبرر قانوني، وحتى بدون إعلام عائلته، وأخيرًا ذاق مرارة الجحيم تحت أيادي الأمن العام. وقد قبع "عمار الزبيدي" في أقفاص سفلية تشكّل مركز الاحتجاز التابع للأمن العام، لمدة ثلاثة أشهر، اتّصل فيها بالمركز اللبناني لحقوق الانسان عدة مرات، بدا خلالها يائسًا ومنهكًا. ولكن سرعان ما مُنع عن الاتصال بمنظمتنا.

واستطاع المركز اللبناني لحقوق الانسان أن يجتمع بالمحتجز لفترة وجيزة في 12 نيسان/آبريل، وذلك بحضور ضباط من الأمن العام. وفي ذلك اللقاء، بدا أنّ صحته الجسدية والنفسية متدهورتين جدًا، فوجهه كان شاحب اللون، وترتسم عليه ملامح الحيرة .
وبما أنّ دخول مركز الاحتجاز ممنوع على كلّ من "المفوضية السامية للامم المتحدة لشؤون الآجئين"، والمحامين، لم يبلّغ أنّ مقابلته المتعلقة بإعادة توطينه قد تقررت في 19 أيار/مايو إلا بعد فوات الأوان.

وبالاستناد إلى اتفاقية مناهضة التعذيب التي صادق عليها "لبنان" سنة 2000، يُلاحَظ أنّ تصّرف الأمن العام ينطبق عليه تمامًا تعريف التعذيب كما ورد في هذه الاتفاقية، إذ إنّ الأمن العام يبقي المحتجزين في مركز الاحتجاز السفلي التابع له، ويعرضهم لشتى أنواع الحرمان، والإهانات، بدون أي رقابة خارجية حقيقية، وذلك بغية حملهم على التوقيع على أوراق "العودة الطوعية" إلى بلدان المنشأ بدون الأخذ بعين الاعتبار بأنّ " تعترف بهؤلاء المحتجزين كلاجئين.

وعلاوة على ذلك، يشكل تصرف الأمن العام انتهاكًا للمادة الثالثة من اتفاقية مناهضة التعذيب التي تحظر ترحيل أي شخص إلى بلد يواجه فيه خطر التعذيب.

ويطالب المركز اللبناني لحقوق الانسان بالإفراج بدون أي تأخير، عن كلّ اللاجئين المعترف بهم، المحتجزين بطريقة غير شرعية في السجون اللبنانية ، وبأن تتوصل الدولة اللبنانية والمفوضية السامية للأمم المتحدة لشؤون اللاجئين" والسلطات اللبنانية إلى اتفاق حول وضع اللاجئين، كما وأنّ المركز يناشد بالإيقاف الفوري لشتى أنواع التعذيب التي يمارسها الأمن العام، بالإضافة إلى وضع آلية فعالة لمراقبة مركز الاحتجاز هذا وانشاء مركز احتجاز آخر يحترم حقوق الإنسان .

ويحمّل المركز اللبناني لحقوق الانسان، السلطات اللبنانية المسؤولية المباشرة والكاملة، لأي ضرر قد يلحق بمصير "عمار الزبيدي" لعودته إلى "العراق"، ويطالب المركز من وزارة الداخلية العمل مع السلطات العراقية لاتخاذ الخطوات الضرورية كافة، من أجل ضمان عودته القانونية إلى "لبنان"، حتى يستطيع حضور مقابلته عن "إعادة التوطين" المقررة انعقادها في 19 أيار/ مايو.
